General Terms and Conditions

§ 1 SCOPE OF APPLICATION & CONTRACTING PARTY

1. These General Terms and Conditions (GTC) apply to all contracts for the temporary rental of apartments and holiday homes (hereinafter “Property”) for accommodation purposes concluded between HAPPY HOMES GmbH (“HAPPY HOMES”) and third parties (“Guest”), as well as to all additional services provided.

2. The contractual partner of the Guest in Spain is HAPPY HOMES.

3.     The Guest’s own terms and conditions shall apply only if expressly agreed in text form.

§ 2 RESERVATIONS / BOOKINGS

1.     By making a booking, the Guest submits an offer to conclude an accommodation contract. Subject to availability, a confirmation will be issued, thereby concluding the contract.

2.     Offers are non-binding and subject to availability.

3.     Booking a category does not entitle the Guest to a specific Property.

§ 3 CANCELLATION / NO SHOW

1.     A reservation is only guaranteed after payment. Cancellation conditions apply. In case of no-show, 90% of the accommodation price is due unless the Guest proves lower damages.

2.     Same-day bookings must be paid immediately.

§ 20 FINAL PROVISIONS

1.     Amendments require text form.

2.     Place of performance is the registered office.

3.     Jurisdiction is the registered office.

4.     German law applies.

5.     Invalid provisions do not affect validity.

6.     No obligation to participate in dispute resolution.

Notice: In the event of discrepancies between language versions, the German version shall prevail.
